If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

Please note that we only provide our site for domestic and private use. Without prejudice to that, the following terms apply.

If you are a business user:

We exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on it.
We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

use of or reliance on any content displayed on our site.

If defective digital content that we have supplied, damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation. However, we will not be liable for damage that you could have avoided by following our advice to apply an update offered to you free of charge or for damage that was caused by you failing to a) correctly follow installation instructions or b) to have in place the minimum system requirements advised by us or c) to have in place suitable virus protection software.

We are not responsible for viruses

We do not guarantee that our site, including without limitation .gpx files you download from it, will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

We may suspend or withhold your use

The actions and responses described above are not limited, and we may take any other action we reasonably deem appropriate in respect of breach of our Acceptable Use Policy or our Terms of Website Use Policy.

Waiver and release of liability

In consideration of Mallorca Cycle Shuttle and Mallorca Bicycle Rescue providing the site in connection with activities including, but not limited to cycling and route planning (the “Activities”), you agree to the terms of this Mallorca Cycle Shuttle and Mallorca Bicycle Rescue Waiver and Release of Liability (“Release”) set out below.

You fully understand and acknowledge the following:

The Activities have inherent risks, dangers, and hazards;
Your participation in the Activities carries with it the potential for property loss and serious injury or illness, including, but not limited to, bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability;
The risks and dangers arising out of or related to the Activities may be caused by negligence of yourself, the owners, employees, officers or agents of Mallorca Cycle Shuttle and Mallorca Bicycle Rescue, the negligence of sponsors, manufacturers, manufacturers, bike dealers, highways authorities, drivers of vehicles, promoters, clubs, agencies, personal trainers, participants, or other parties, as well as accidents, breaches of contract, the forces of nature, or other causes. Risks and dangers may arise from foreseeable or unforeseeable causes including, but not limited to, those caused by terrain, darkness, altitude, temperature, weather, condition of participants, equipment, inadequate safety equipment, vehicular traffic, actions of other parties, fixed or moving objects, lack of hydration, and such other risks, dangers, and hazards that are integral to the Activities in an outdoor or recreational environment; and
You assume all risks and dangers relating to the Activities and all responsibility for any losses and/or damages. You are also solely responsible for whether you will or will not wear a helmet or other protective gear or equipment.
Further, to the fullest extent permitted by law, you on behalf of yourself, your personal representatives and your heirs voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify Mallorca Cycle Shuttle and Mallorca Bicycle Rescue, and its owners, agents, officers and employees from any and all claims, actions or losses which may arise out of your use of Mallorca Cycle Shuttle and Mallorca Bicycle Rescue services arising out of or relating to the Activities; and
specifically understand that you are releasing, discharging, and waiving any claims or actions that you may have presently or in the future for the negligent acts or other conduct by the owners, agents, officers or employees of Mallorca Cycle Shuttle and Mallorca Bicycle Rescue.

If part of these terms becomes invalid

If any provision or part-provision of these Terms of Website Use is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of these Terms of Website Use.

Which country’s laws apply to any disputes

If you are a consumer, please note that these Terms of Website Use, their subject matter and their formation, are governed by Spanish law. You and we both agree that the courts of Spain will have exclusive jurisdiction.

If you are a business, these Terms of Website Use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by Spanish law. We both agree to the exclusive jurisdiction of the courts of Spain.
